By accessing or using the CrispForms website (crispforms.com) or application (app.crispforms.com) (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and CrispForms.
2. Description of Service
CrispForms provides an online platform for creating, publishing, and managing conversational forms, surveys, and quizzes. The Service includes a free tier with core features and paid plans (Pro and Lifetime) that offer additional functionality such as webhooks, removal of branding, Stripe payments integration, and calendar integrations. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.
3. User Accounts
To use certain features of the Service, you must create an account. You agree to: (a) provide accurate, current, and complete information during registration; (b) maintain and promptly update your account information; (c) maintain the security of your password and accept responsibility for all activities under your account; and (d) notify us immediately of any unauthorized use. You must be at least 18 years of age or the age of legal majority in your jurisdiction to use the Service.
4. Free and Paid Plans
CrispForms offers a Free plan with unlimited forms and submissions, and paid plans including Pro (monthly or annual) and Lifetime. Features, limits, and pricing may change. We will provide reasonable advance notice of material changes to pricing. Free plan users may upgrade at any time. Paid plan users are subject to the terms of their chosen subscription.
5. Payment Terms
For paid plans, you agree to pay all applicable fees as described at the time of purchase. Fees are charged in advance for subscription periods (e.g., monthly or annually). Payment is processed through our third-party payment processor (Stripe). By providing payment information, you authorize us to charge the applicable fees.
Subscription fees are non-refundable except as required by law or as explicitly stated in our refund policy. For monthly subscriptions, you may cancel at any time; cancellation will take effect at the end of the current billing period. For annual and Lifetime plans, refunds are handled on a case-by-case basis; contact support for assistance.
6. Intellectual Property
CrispForms and its licensors own all rights, title, and interest in and to the Service, including the software, design, trademarks, and content (excluding User Content). You may not copy, modify, distribute, sell, or create derivative works of the Service without our prior written consent. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose subject to these Terms.
7. User Content
"User Content" means any content you create, upload, or submit through the Service, including forms, questions, responses, and data collected via your forms. You retain ownership of your User Content. By using the Service, you grant CrispForms a worldwide, non-exclusive, royalty-free license to host, store, process, and display your User Content solely to provide and improve the Service.
You represent that you have all necessary rights to your User Content and that it does not violate any third-party rights or applicable laws. CrispForms is not responsible for User Content. You are solely responsible for obtaining any consents required from form respondents and for compliance with applicable data protection laws.
8. Prohibited Uses
You agree not to use the Service to:
- Violate any applicable laws, regulations, or third-party rights
- Spam, phish, or engage in deceptive or fraudulent practices
- Collect personal information without proper consent
- Transmit malware, viruses, or harmful code
- Attempt to gain unauthorized access to the Service or other users' accounts
- Reverse engineer, decompile, or disassemble the Service
- Use the Service for any illegal or unauthorized purpose
- Interfere with or disrupt the Service or its infrastructure
We reserve the right to suspend or terminate accounts that violate these prohibitions.
9. Limitation of Liability
To the maximum extent permitted by law, CrispForms and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.
Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100). Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages; in such jurisdictions, our liability is limited to the fullest extent permitted by law.
10. Termination
You may terminate your account at any time by contacting us or through account settings. We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) will survive.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware.
